These Terms of Service (“Terms”) govern your use of the website at thepesthound.com and related services operated by The Pest Hound LLC (“The Pest Hound,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Services.
1. Description of Services
The Pest Hound LLC operates a B2B lead generation marketplace that connects consumers seeking pest control services with independent, licensed pest control service providers. The Pest Hound is NOT a pest control service provider. We do not perform extermination, fumigation, inspection, treatment, or any pest control services.
Our Services include:
- Generating consumer inquiries (calls and form submissions) for pest control services
- Routing those inquiries exclusively to vetted independent pest control companies in our network
- Providing pest control companies with paid access to those inquiries through a prepaid wallet model
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.
3. Independent Service Providers — Important Disclaimer
You acknowledge and agree that:
(a) The Pest Hound is a marketing and lead generation platform only. We are not a pest control service provider and do not perform pest control services of any kind.
(b) All pest control services advertised, requested, or provided through the Services are performed by independent, licensed pest control service providers (“Service Providers”), not by The Pest Hound.
(c) Service Providers are not employees, agents, partners, or joint venturers of The Pest Hound. They are independent businesses operating under their own licenses and authority.
(d) The Pest Hound is not a party to any agreement between you and a Service Provider. The terms of service, pricing, scheduling, quality of work, and warranties are determined solely by the Service Provider.
(e) The Pest Hound makes no representations, warranties, or guarantees regarding any Service Provider, including but not limited to their licensing status, quality of work, pricing, availability, or business practices.
(f) You are responsible for verifying the credentials, licensing, and suitability of any Service Provider before engaging them.
4. Partner Networks
The Pest Hound uses third-party lead distribution and pay-per-call networks, including but not limited to Marketcall (operated by Marketcall LLC), to route consumer calls and inquiries to Service Providers. By using the Services, you acknowledge that:
- Calls and form submissions may be routed through partner networks
- Calls may be recorded for quality, training, fraud prevention, and compliance purposes
- Your information may be shared with partner networks and Service Providers as described in our Privacy Policy
5. Pest Control Company Partner Accounts
If you are a pest control company that uses our Services to receive consumer leads (“Partner”), you agree to additional terms:
(a) Account Registration
You must provide accurate, complete information about your business, including legal name, ownership, licensing, insurance, and service area.
(b) Licensing and Compliance
You represent and warrant that you are properly licensed and insured to perform pest control services in every jurisdiction where you accept leads. You are solely responsible for compliance with all federal, state, and local laws governing your business.
(c) Wallet and Payment
You will fund a prepaid wallet from which lead fees are deducted as leads are delivered. Wallet funding is processed via Stripe and other payment processors. Wallet balances are non-transferable. Refund eligibility is governed by our Refund Policy when published.
(d) Lead Use
Leads delivered to you are for your exclusive use in the agreed service area and pest categories. You may not resell, share, or redistribute leads to other companies.
(e) Service Quality Standards
You agree to maintain professional standards including: timely call response (ideally within 5 minutes), accurate quoting, licensed and insured service delivery, and respectful customer service. The Pest Hound reserves the right to remove Partners who fail to meet these standards.
(f) Independent Contractor Status
You are an independent business. Nothing in these Terms creates a partnership, employment, agency, or franchise relationship between you and The Pest Hound.
6. Consumer Use of Services
If you are a consumer using the Services to find pest control services:
- You consent to be contacted by Service Providers and partner networks at the contact information you provide
- You acknowledge that calls may be recorded
- Service quality, pricing, and delivery are the responsibility of the Service Provider, not The Pest Hound
- You are responsible for verifying any Service Provider’s credentials before engagement
7. Prohibited Uses
You agree not to:
- Use the Services for any unlawful purpose
- Submit false, misleading, or fraudulent information
- Attempt to gain unauthorized access to the Services or related systems
- Scrape, harvest, or collect data from the Services without express permission
- Interfere with or disrupt the Services
- Use the Services to send spam, unsolicited communications, or violate the TCPA, CAN-SPAM Act, or other applicable laws
- Reverse engineer, decompile, or attempt to extract source code from the Services
8. Intellectual Property
All content on the Site, including text, graphics, logos, images, software, and the “The Pest Hound” name and mark, is the property of The Pest Hound LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our express written permission.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
The Pest Hound does not warrant that the Services will be uninterrupted, error-free, or completely secure. We do not warrant the quality, accuracy, or reliability of any pest control services performed by Service Providers.

10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PEST HOUND LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless The Pest Hound LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your breach of these Terms; (c) your violation of any law or third-party rights; or (d) any services performed (or not performed) by any Service Provider you engaged through the Services.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
13. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or related to these Terms or the Services shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court. The arbitration shall be conducted in Missouri, in the English language. Judgment on the arbitrator’s award may be entered in any court of competent jurisdiction.
YOU AND THE PEST HOUND AGREE THAT ANY CLAIMS WILL BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
Notwithstanding the above, either party may bring an individual action in small claims court or seek injunctive relief in court for intellectual property infringement.
14. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles. Any action not subject to arbitration shall be brought exclusively in the state or federal courts located in Missouri.
15. Modifications
We may modify these Terms at any time by posting the revised Terms on the Site. The “Last updated” date will reflect the most recent revision. Your continued use of the Services after any modification constitutes acceptance of the revised Terms. Material changes may be communicated via email or prominent notice on the Site.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, Disclaimers, Do Not Call Policy, and any other policies referenced herein, constitute the entire agreement between you and The Pest Hound regarding the Services.
